Minutes of the meeting held on Monday 16 September
2002 at 7.30pm in Maryculter Community Hall.

MINUTES of the meeting of 19th August 2002 was approved
after the following amendments: Rural Schools Closure, Hamish Vernal not
Vernon. Line - "Mike queried the role of Banchory-Devenick school",
should read : "Mike queried the projected roll of
." : Golf
driving range - Lines 5 to 7 should read : . He also suggested not using
a Q.C. as the advice would not be specific enough. Bill wouldn't like to
see the Cults side overtake us and Mr Gauld's case go through. It was agreed
to approach John Agnew to collate the information
: Special Area of
Conservation (SAC) Rob noted that the Red Moss area of Netherley is being
proposed as an SAC , it was agreed to find out just what effect this might
have on nearby development.
: AOCB : Questionnaire received from Council on plants and flowers to be
used to decorate villages etc in 2003. It was agreed to pass to Corbie Hall
Committee for their use. |

Matters Arising

Rural Schools Closure

Philip and Mike had attended a meeting at Mackie Academy, there were
a number of Banchory-Devenick parents who were against the merger. Sandy
had spoken to Hamish Vernal and felt that a two school merger could go
ahead and that Alan Findlay also would support this. The questionnaire
sent out in the area was poorly worded and distributed. The consensus
was that the right questions had not been asked. Philip reiterated that
using the comments box was most important. Steve Davies - Netherley School
Chairman had arranged a leaflet drop in the area to better explain their
position. Sandy's view was that Netherley and Maryculter schools should
merge although he will listen to what the community wants. It was felt
that Maryculter School parents should be advised. Wherever the new school
was sited it was likely that 20 new houses would be allowed in that area.
Sandy's view was that the Lairhillock site was not cut and dried and in
many ways would not be suitable. George queried the numbers of houses,
Sandy explained that 10 houses at each of Netherley and Maryculter West
schools were in the new Plan. Mike asked for confirmation that the Council
would be responsible for upgrading roads. Sandy thought that a more suitable
site might be on the South Deeside road between the caravan park and Templars,
especially if the proposed improved facilities go ahead. Rob said that
the proposed 281 houses at Blairs could still go ahead, might be decided
by December.
Philip was mandated to present a view to the council, Bill suggested that
this would help clarify people's thinking. Rob said we should send a letter
rather than arrange a questionnaire as time was short, the analysis of
questionnaires will be completed and sent to the Council by 7 October.
Bill felt that asking for more information on a two school merger would
be more beneficial, Mike agreed. Sandy suggested he write to Maryculter
parents as their local councillor. It was agreed to form a sub-committee
of Sandy Wallace , and Philip Smart to pursue the matter, and contact
representatives from Maryculter PTA, Netherley and Banchory-Devenick schools.
Rob asked if we should involve the media, it was agreed that we should
not at the moment.

Roads
|

The promised study on the B979 will
be completed later this year. Roads and Road maintenance are on the Agenda
of the next Community Council Forum on 26 September.

Police Report
|

Two Officers attended and gave their report.
Several road accidents had occurred and it was stressed that road conditions
were slippery with rain after a long dry spell, please drive according to
conditions. Philip asked if the recent accidents on the B979 would appear
as statistics. If they were reported they would be. There had been reports
of suspicious vehicles in the area, and a request to report anything suspicious.
With the days getting shorter, precautions on house security should be taken,
time switches etc. George Masson asked, if his alarm went off , how long
before an officer attended. Mike asked if their were special reserves, no
but in a real emergency an officer would be called from Aberdeen or Montrose.
Sandy said there were usually enough police, and felt that the police were
doing a good job, but the legal system was letting everyone down. Often
the people who do get caught either do not get to court or if they do are
not punished. There was also a lot of time wasting for witnesses and police
when cases were dropped for various reasons. |

Planning

Area Local Plan (ALP)
|

The Area Local Plan has been published
and objections are must be in by 8th October. Rob and Philip will examine
it, draft our objections, probably concentrating on steading conversions,
settlement envelopes and wind farms, and circulate them to Community Councillors
before submission. Copies are available at libraries and on the Web. ALP
will be much stronger than CALP it replaces, and now starts to carry more
weight in planning decisions, as CALP conversely starts to carry less.
Sandy will be objecting to the proposed ban on developing old steadings
The appeal against planning refusal for four Stobhall properties Plots 4-7
has been refused.
It was noted that the policy on Windfarms could lead to councils having
difficulty refusing any developer no matter how unsuitable. |

road - The second application (retrospective) for siting of caravans is
likely to go to committee in October. |

This 3 year old application (hotel, chalets, golf course ,
281 houses etc) may finally go to committee before Christmas as the developer
is pressing for it to be considered.(Sandy is also anxious to bring it forward
due to its effect on primary school decision) |

Rob reported he had been unable to meet Phillipa from the
Forestry Commission as she was off work, but was due to meet Jim Sneaton
on 17th September. |
