MINUTES of the meeting of November 17th were approved, subject to two amendments:
1. roads: 4th line delete “all”, 2. Portlethen 1st line replace “expressing our concerns” with “requesting information about the ppp school bid”
1. MATTERS ARISING
Web site – Nothing to report.
Western Peripheral Route – It was agreed that major changes could be made to the route or its method of construction only by way of the Public Inquiry. NKRCC current intention is to make sure the scheme is as good as possible in the detail of how it may affect our residents. The Managing Agents team had been set up. An exhibition of the final design is set for August 2004. Kate said that most people she spoke to wanted more information on the route.
Roads – The poor state of some roads was commented on. It was suggested that potholes should be reported to the Roads dept, if vehicles sustain damage also contact the Roads Dept. The Scottish Executive plan to have part-time speed restriction of 20mph outside all schools, this will be achieved in three tranches funded by Scottish Executive. Schools in our area appear to meet the criteria for tranche 3.
Blairs Hearing – Nothing to report, although Rob and the other participants had been congratulated by Willie Munro on their presentation. The requirement for an assessment of the development’s effect on the River Dee (Special Area of Conservation) appears likely to delay a decision by another month or more.
New School – Philip attended the consultation group meeting. In response to the question on the ‘Funding Gap’ raised at the last NKRCC meeting the council official’s response was we would get exactly what had been presented. There was consternation when Ms Birnie stated that all children from the school would go on to Portlethen Academy, though this was later contradicted by the ppp team and Councillor Wallace. Steve Davis asked if the site was the best available. In this regard Sandy had written to the Scottish Executive to ask that the matter be ‘called in’. His letter was discussed as he had placed emphasis on a reference that the Community Council was opposed to the proposal . NKRCC is listed as an objector but this is in regard to the road works that the council officials have chosen to associate with this scheme and also on road safety grounds. The is reference in the NKRCC submission to the Council clarifying the choices made in respect of site chosen and associated development not to the principle of a new school. Philip will write the Executive to clarify our position.
2. PLANNING
Local Plan – Public Inquiry. Nothing more to report, due to start 19th January 2004.
Rupert Lumsden – His proposal for 10 houses opposite Banchory-Devenick school had elicited various reactions in Banchory –Devenick, Duncan reported that those he spoke to felt that if the properties were ‘affordable’ the plan would be acceptable. It was suggested that Rupert attend our next meeting to explain his proposal.

Police report: During November there were two accidents causing injury on the South Deeside Road due to driver error. An empty house at Banchory-Devenick had been broken into. A cycle had been stolen from a house in the Blairs area. Robert commented that there had been over 20 reports of break-ins in Portlethen and Newtonhill in the preceding two weeks so take care
We had received a letter from W Munro regarding potential clashes of interest over certain Planning applications. NKRCC felt that it complied with the community council handbook guidelines but that Mr Munro had raised additional issues. It was agreed that Rob would seek clarification on this matter.
Bill was waiting for Scottish Rights of Way to write to him on the outcome of their meeting with the Council, regarding the Right of Way at Haugh of Ardoe. It may be that the ‘Right to Roam ‘ legislation would settle the issue.
